Denver announces first homeless sweeps following ruling requiring advanced notice

The city of Denver will conduct two sweeps of homeless encampments next week on Feb. 10 and 11, the first since a federal judge ordered the city must provide more notice and explanation before conducting sweeps.
The city’s announcement provided a seven-day notice before the first sweep, in adherence to the ruling. In emergencies, the city may give a two-day notice if the Colorado Department of Public Health and Environment must sign off.
The sweeps will start at 6:30 a.m. on Stout Street from 22nd Street to Park Avenue and on Champa Street from California Street to Park Avenue, conducted by the Department of Transportation and Infrastructure.

In addition to the announcement coming earlier than normal, it also offered more explanation than previous announcements.
Now, the city is required to inform Attorney Andy McNulty and the district’s City Council representative of the sweeps and why they are happening.
The notice said DOTI has determined these sweeps necessary because a large encampment in the area is obstructing walkways and resulting in piles of trash, discarded food and human waste.
DOTI also said it was notified of fire hazards like burnt charcoal, containers of gasoline and tents too close to windows by the Denver Fire Department.

The Denver Department of Public Health and Environment said the conditions of the encampments do not require public restriction.
Despite current compliance, the city filed an appeal against the federal order requiring seven-day notice before sweeps. Last week, Denver filed an emergency court order that would allow it to continue conducting sweeps without notice.
During the upcoming sweeps, the city will remove all items obstructing public areas and store any property at 1449 Galapago St. If not claimed within 60 days, the property will be thrown away.
