Pueblo County District Attorney Jeff Chostner said Martinez was an endorsed witness for the prosecution of Donthe Lucas, who is accused of killing his 21-year-old ex-girlfriend Kelsie Schelling in 2013.
Schelling was eight weeks pregnant at the time of her murder and was reported missing in February 2013.
Lucas was charged with her death in December 2017, although her body has never been found.
Martinez had not testified in the murder trial.
