'Lost, not stolen’: Group of conservatives rebuff stolen election claims in report

A group of conservatives repudiated claims that election fraud deprived former President Donald Trump of victory in 2020.

Eight prominent conservatives, including lawyers and former judges, examined 64 court cases in which Trump and his allies challenge the election and determined that Trump allies “failed to produce substantive evidence” to back their claims. They issued a 72-page report on the matter.

“Our conclusion is unequivocal: Joe Biden was the choice of a majority of the Electors, who themselves were the choice of the majority of voters in their states,” the report said. “Biden’s victory is easily explained by a political landscape that was much different in 2020 than it was when President Trump narrowly won the presidency in 2016.”

The report, titled “LOST, NOT STOLEN: The Conservative Case that Trump Lost and Biden Won the 2020 Presidential Election,” analyzed claims from Trump allies about malfeasance in key states. The report was published on the website Lostnotstolen.org.

“We do not claim that election administration is perfect. Election fraud is a real thing; there are prosecutions in almost every election year, and no doubt some election fraud goes undetected,” the report continued. “But there is absolutely no evidence of fraud in the 2020 Presidential Election on the magnitude necessary to shift the result in any state, let alone the nation as a whole.”

Thomas Griffith, Michael Luttig, and Michael McConnell, all retired federal appeals court judges, were listed as authors of the report. They were joined by Theodore Olson, former U.S. solicitor general; former Missouri GOP Sen. John Danforth, former Oregon GOP Sen. Gordon Smith, election lawyer Benjamin Ginsberg, and former GOP congressional chief of staff David Hoppe.

Ginsberg and Luttig gave testimony to the House Jan. 6 committee. Some of the authors had previously criticized Trump publicly, but they emphasized they did not switch allegiance to the Democratic Party and harbor no “ill will” toward Trump or his supporters while encouraging conservatives to acknowledge the loss.

Some Trump supporters have noted that many of the election court cases they lost were the result of a lack of standing or other proceeding grounds, not necessarily the underlying claims.

However, in addition to reviewing court cases, the report also assessed other reviews of the election, including in Arizona, Georgia, Michigan, Nevada, Pennsylvania, and Wisconsin. One example of a review assessed by the report was the Maricopa County election audit conducted by Cyber Ninjas, which was hired by Arizona Republicans to review the election. Another example was the recount of Georgia votes that reaffirmed Trump’s loss in the Peach State.

The report comes as the Jan. 6 committee is holding public hearings about the efforts of Trump allies to challenge the election after the loss and ties to the Capitol riot. Trump continues to maintain that the election was stolen. In August, before the election took place, he told his supporters that the only way he could lose would be if it were “rigged.” Trump ultimately claimed victory on election night despite many votes remaining outstanding in key states.

“We urge our fellow conservatives to cease obsessing over the results of the 2020 election, and to focus instead on presenting candidates and ideas that offer a positive vision for overcoming our current difficulties and bringing greater peace, prosperity, and liberty to our nation,” the report said.
