Colorado Springs family sues McDonald’s, Taylor Farms over E. coli exposure

A Colorado Springs mother and her 10-year-old child are suing McDonald’s and Taylor Farms after each of them ate a Double Quarter Pounder hamburger in mid-October and were exposed to E coli.

Geovanna Zambrano, whose name has not been public until now, and her daughter consumed the burgers immediately after buying them on Oct. 17 at the McDonald’s restaurant at 390 S. 8th St., according to the lawsuit.

The next day they experienced nausea, stomach cramps, fatigue and diarrhea, which are symptoms associated with E. coli poisoning, according to the lawsuit. 

That day, as symptoms got worse, the two went to Evans Hospital, were diagnosed with viral gastroenteritis, and sent home with medications, the lawsuit states, and the symptoms continued “for several days.” 

The outbreak was first reported by the hamburger chain on Oct. 22. An early investigation by several health agencies determined it was linked to raw, slivered onions supplied by Taylor Farms. McDonald’s stopped getting their onions from the Taylor Farms facility indefinitely, but not before the outbreak sickened at least 104 people in 14 states.

At least one person died. James “JC” Charles Smith, 88, fell ill Oct. 3 and died after E. coli exposure, according to his daughter, Debbie Bonnell. The former firefighter and U.S. Postal servicer worker died Oct. 20. Legal fallout includes a class action lawsuit.

The Centers for Disease Control announced on Dec. 3 that the outbreak was over. 

The latest lawsuit said that Zambrano is suing McDonald’s because “it designed, manufactured, assembled, supplied, packaged, produced, distributed, and sold directly to plaintiff the contaminated food product that is the subject of this action in a defective and unreasonably dangerous condition.”

The lawsuit was filed Dec. 16 in Cook County, Illinois, the home of McDonald’s corporate headquarters. Taylor Farms Colorado is located in Colorado Springs at 890 N. Newport Road.

Zambrano, 29, works at a Colorado Dunkin’ Donuts restaurant. According to her LinkedIn profile, she has “advanced experience while handling food in a fast-paced environment.” 

Zambrano and her daughter were not available for interviews.
