The First Judicial District Attorney’s Office charged a man for allegedly kidnapping and assaulting a waitress at a Golden bar last week.
The Jefferson County Sheriff’s Office arrested 30-year-old Brandon Montano on May 21 at the Rock Rest Lodge near Golden after he allegedly shoved a server into a bathroom, attempted to choke her and threatened her with a handgun.
A week later, on Thursday, the district attorney’s office charged the man with one count of second-degree kidnapping, second-degree assault, menacing, third-degree assault, false imprisonment, prohibited use of a handgun and a crime of violence sentence enhancer, the district attorney’s office told The Denver Gazette Friday.
The incident occurred around 1:30 p.m. May 21. A sheriff’s office deputy was called to the bar and grill on a report of menacing, according to arrest records.
Montano entered the bar and told the staff he was there for a business meeting, witnesses claimed in the arrest affidavit. Montano then ordered a beer from his 23-year-old server.
After getting the beer, Montano told the server that his wife left something in the bathroom. While the server went to the bathroom to check, Montano allegedly pushed in behind her and forced her into a stall.
Montano then allegedly put his left arm around the server’s neck, placing her in a headlock and restricting her breathing. He then put a handgun to her head and covered her mouth.
The server continued to fight Montano. The magazine eventually dropped from the 9mm Desert Eagle. The server was able to force the handgun downward, pulling the trigger to empty the chamber. There was not a bullet inside of the chamber, though, according to arrest records.
The server wrestled the handgun from Montano and ran out of the bathroom, gathering coworkers to help her subdue the suspect. They eventually placed him on the ground with his hands behind his back before deputies arrived.
Inside Montano’s pockets was a fake Air Interdiction Agents badge, a knife and handcuffs. A deputy also claimed that Montano smelled of alcohol, according to the arrest affidavit.
The server claimed to not know Montano, but said she had seen him at the last restaurant she served at. She had made a social media post that day for followers to come see her at Rock Rest Lodge.
Montano is due for a preliminary hearing on June 18.
