JeffCo road rage shooter court proceeding delayed 35 days for discovery
An attorney representing Matthew Impellitteri, a Jefferson County man accused of shooting a woman in the head during a November road rage incident, requested a 35-day continuance Wednesday to go through discovery.
Impellitteri’s lawyer Doug Richards told First Judicial District Judge Keith Gorman that attorneys for both sides still needed time to make their way through the mountain of discovery, which is evidence collected by prosecutors. Impellitteri, 56 and attending via WebEx from jail, agreed to waive his right to hold another hearing within 35 days.
The defense attorney, outside the scope of the WebEx camera and not named during the proceeding, agreed with the sentiment, noting that the victim, 38-year-old Kassi Moy, has not yet able to meet with them, as she continues to recover from her injuries in the hospital.
Impellitteri faces 10 charges in connection with a Nov. 11 shooting near Morrison that left Moy in critical condition.
Moy’s boyfriend, 45-year-old Timothy Wilson, had been driving them both on Highway 285 near Settlers Drive when he passed a yellow hatchback car in the right lane, according to a probable cause affidavit for Impellitteri’s arrest. After passing the car, it sped up and pulled alongside them.
Then, two gunshots rang out and Moy stopped responding to Wilson, according to the affidavit. The car then fled the scene. Police later found the yellow Subaru behind Impellitteri’s home and arrested the man without incident.
A GoFundMe page created three days after the shooting has raised more than $120,000 as of Wednesday afternoon. A new message posted on Monday notes that Moy has been undergoing rehab and just recently started strength exercises.
Impellitteri’s next hearing is scheduled for Feb. 25 at the Jefferson County courthouse.
