Lakewood assisted living employee charged with negligence of elderly residents

Lakewood police on June 9 arrested an assisted-living employee on charges of negligent bodily injury.

She was released on $5,000 bond.

Ashley Ann Garcia, 35, was arrested and charged in relation to two instances of elderly neglect, according to a First Judicial District Attorney’s Office news release.

The initial report was made July 2, 2025, when the granddaughter of a Rocky Mountain Assisted Living Facility resident observed a severe skin tear on her grandmother’s arm. The injury extended from her elbow to her wrist.

The resident was 100 years old at the time and required hospitalization. The family of the resident was told the injury occurred during assistance from a fall but was skeptical about the validity of the alleged cause, according to the news release.

Police were made aware of another incident at the facility involving Garcia while investigating the elderly woman’s case. About 24 hours prior, a male resident fell three times under the care of Garcia, the news release said. During these falls, Garcia did not follow proper protocol such as the use of a gait belt and 911 assistance.

Both incidents occurred less than 30 days into Garcia’s employment at the facility.

“Following the investigation by the Lakewood Police Department, on Feb. 3, 2026, the First Judicial District Attorney’s Office filed two felony charges against Garcia: one count of Negligent Serious Bodily Injury to an At-Risk Person (Victim 1) and one count of Negligent Bodily Injury to an At-Risk Person (Victim 2). An arrest warrant was issued the same day,” the news release said.

Garcia’s first court appearance was June 22. She will be required to attend another hearing on July 22.
