A man was arrested Monday after a shooting in Commerce City left an 85-year-old bystander in critical condition.

The shooting happened at about 2:45 p.m. Monday, according to an arrest affidavit. The Commerce City Police Department notified the public at about 4:45 p.m. as officers issued a shelter-in-place order and searched the area near 60th Street and Monaco Street for the shooter. Initial witness reports said two parties were firing at each other across the street when a woman sitting in her car at the intersection was struck and critically wounded.

The woman was taken to a hospital. She is expected to survive her injuries, police said. A bullet entered her car and struck her in the leg, shattering her femur, the affidavit said.

Police later located and arrested the accused shooter, who police identified as Jeremiah Tyrae Herrera, 19. He was booked into the Adams County Sheriff’s Office jail, and faces two charges of attempted murder, one charge of aggravated assault and one charge of a felon in possession of a firearm. Herrera was previously convicted of possession of a handgun by a juvenile in 2023, the affidavit said.

Herrera was identified as a suspect after a witness to the shooting identified him to police. When searching a law enforcement database, officers found an address associated with Herrera, his grandparents’ house, was near the scene of the shooting.

Police went to the address and arrested Herrera, also finding firearms and narcotics in a shed on the property, according to the affidavit. Herrera waived his Miranda rights and spoke to police, in which he said he had a longstanding feud with the person he shot at which had recently escalated. Herrera claimed the other person had been threatening his family and had sent him a video the day of the shooting showing the man driving past Herrera’s grandparents’ home while pointing a gun out the window.

Herrera told police he waited at his grandparents’ home for several hours waiting for the man, and encountered him at a convenience store after leaving the house. The man was armed and shouted at Herrera, he told police, leading Herrera to open fire.

However, surveillance footage from the store showed the man was not armed, but an unidentified person with the man was the one who fired back at Herrera. Herrera told police he fled back to his grandparents’ house after the shooting.
