Ex-Broncos linebacker Randy Gregory sues NFL, claims fines for using medications with THC were unjust
Former Broncos outside linebacker Randy Gregory filed a lawsuit Wednesday against the NFL and the team for what he considers unjust fines totaling $532,500 for medications using THC.
The complaint, filed in Arapahoe County, was first reported Thursday by BusinessDen, and a copy was placed online.
In the suit, Gregory claims he was prescribed Dronabinol, a medicine used for his social anxiety and post-traumatic stress disorders, and he was fined following drug tests for testing positive for THC. He claims he was being discriminated against due to his disabilities.
The Broncos don’t play a role in players being fined after drug tests, the NFL does. The Broncos declined to comment on the suit.
Gregory, after signing as a free agent, spent 2022 with the Broncos before being traded after four games last season to San Francisco. He is now with Tampa Bay.
Gregory’s agent, Peter Shaffer told The Denver Gazette his client is seeking reimbursement from the fines as well as other damages and the ability to not be fined in the future for using the medications prescribed by doctors.
“This has nothing really to do with the Broncos,” Schaffer said. “This is really the NFL. Randy’s got a prescription in a state (Colorado) where marijuana is legal, and we’re trying to get a reasonable accommodation to treat his disabilities at the direction of his physician. If his physician says this is a legal pain management option and everybody else in the state can do it, why can’t Randy or any Broncos player?”
Gregory has openly talked about his struggles. While with Dallas from 2015-2021, he was suspended multiple times for failed drug tests, including sitting out all of the 2017 and 2019 seasons. The NFL no longer suspends players but does fine them for testing positive for THC.
