Boulder DA files charges in fentanyl overdose death

A man accused of selling another man drugs the night of his death from a fentanyl overdose in Boulder has been charged with allegedly causing the death.

Joseph Robert Moczulewski, 43, was found dead at about 7:20 a.m. on March 2, near Broadway Street and Yarmouth Avenue. An autopsy showed his cause of death was a fentanyl overdose, according to a news release from the 20th Judicial District Attorney’s office.

Gustavo Argumedo-Lopez, 31, was arrested last week after he allegedly sold methamphetamine to an undercover police detective.

Argumendo-Lopez also allegedly confessed to selling drugs to Moczulewski on the night of his death, and digital evidence showed they had been communicating over the phone ahead of Moczulewski’s death.

Argumendo-Lopez has been charged with distribution of fentanyl resulting in death, possession of a controlled substance with intent to distribute, distribution of a controlled substance, unlawful possession of a controlled substance and obstructing a peace officer.

He also faces a probation violation charge. He is being held at the Boulder County jail on $451,000 cash bail.
